
The way for recovery of compensation from those who damage public or private property during strike, bandh, riot and protest in the state has now become clear. Raj Bhavan has approved the Uttarakhand Public and Private Property Damage Recovery Bill passed by the Assembly. Now it will take the form of an Act. The state government had passed the Uttarakhand Public and Private Property Damage Recovery Bill in the monsoon session of the Assembly held in the summer capital Gairsain. It has been arranged in this bill that compensation for property loss will be taken from those who damage public or private property during strike, bandh, riot and protest in the state. The value of the property will be calculated according to the market price.
Not only this, in case of death of anyone in these, legal sections will be applied, along with this, the accused will also have to pay compensation. In case of death, the minimum amount of compensation will be seven lakhs and in case of permanent disability, two lakh rupees. To recover the damage, the concerned department and private person will have to claim within three months. This claim can be made in various claim tribunals headed by retired district judges.
If the charge is framed, the person concerned will have to deposit compensation within one month. Provisions for punishment have also been made for not doing so. These include confiscation of the property of the accused. It includes public property as well as personal damage. In this, along with death, there is a provision for compensation by keeping eye sight, hearing power, limb fracture, deformation of head or face etc. under the scope of disability. Uttarakhand Public and Private Property Damage Recovery Act is very important for the state. The purpose behind making the law is that no one should even think of committing such a crime. Uttarakhand is a peaceful state. If anyone riots, creates a ruckus, vandalizes, commits arson in Devbhoomi, then every penny of the loss of property will be recovered from the same rioter.
