
The UCC expert committee is preparing the report mainly keeping women at the center on the basis of gender equality, so it is believed that Muslim women of the state can also get equal rights in ancestral property. However, it cannot be ruled out that there is a problem regarding this issue.
In Uttarakhand, giving the right to ancestral property to women of all religions is being seriously considered. The expert committee set up to frame the Uniform Civil Code (UCC) is seriously considering the issue. Muslim women have not been given equal rights in ancestral property in Muslim personal law.
Since the expert committee is preparing the report mainly keeping women in the center on the basis of gender equality, it is believed that Muslim women of the state may also get equal rights in ancestral property. However, it cannot be ruled out that there is a problem regarding this issue.
Before the year 2005, Hindu women did not have any right in the property of the parents. He got this right after the order of the Supreme Court in the year 2005. Now they have equal rights with men on ancestral property. But there is Muslim personal law for Muslim women in which they do not have equal rights in ancestral property. But if there is a legal system of property rights for all women in the state, then Muslim women will also come under its ambit.
However, the expert committee working on the Uniform Civil Code is now in the final mode of drafting. Committee member and former Chief Secretary Shatrughan Singh says, the committee has made it clear at the time of its formation that it will work on the basis of gender equality, which includes giving equal rights to women.
Social Security for parents:
The expert committee constituted for UCC is deeply considering social security for those parents in the state, who can be given relief by making some changes in the rules and regulations. In military and paramilitary dominated states, this problem is especially seen in those families, where unfortunately jawans or officers are martyred. In such cases, insurance and other benefits are given to the widowed wife. But in certain cases the parents were deprived of financial security due to the remarriage of the widowed wife.
The issue was raised in discussion with ex-servicemen:
When the expert committee sought suggestions from different sections of the society on the Uniform Civil Code. During that time discussions were also held with ex-servicemen. During the discussion, this issue was raised by the ex-servicemen themselves.
It is true that gender equality has been kept central to the Uniform Civil Code. The subject of equal rights for women is included in the purview of the committee. Election agenda of UCC BJP also:
Uniform Civil Code has been a major election agenda for the BJP. Chief Minister Pushkar Singh Dhami had announced the formation of UCC during the assembly election campaign. As soon as he came to power, he formed an expert committee. Now the draft regarding UCC is going to be prepared before the 2024 Lok Sabha elections. Karnataka is the fourth state where the BJP promised a Uniform Civil Code in its election manifesto. Prior to that Gujarat, Himachal states have also taken initiative in the direction of Uniform Civil Code. BJP has made UCC the main agenda of campaign in Karnataka assembly elections.
