The way has been cleared for the identified agitators and their dependents of the state movement in Uttarakhand to get 10 percent horizontal reservation in government services. Rajbhawan has approved the 10 percent horizontal reservation bill in government services to the identified agitators or their dependents of the Uttarakhand state movement passed by the assembly. Now after the gazette notification, it will become an act. It will be considered effective from 11 August 2004. Also, the appointments of state agitators selected on various state services and posts under the government order issued by the state government on 11 August 2004 and thereafter will be considered valid. A government order was issued in 2004 during the Narayan Dutt Tiwari government, deciding to give reservation to state agitators. On this basis, reservation was being given to agitators in government services. In 2011, the High Court, while hearing on this matter, put a stay on the reservation given to agitators as per the government order. After this, preparations were underway to legalize reservation for agitators, which was completed by passing a bill from the assembly in February this year. In this bill, if the age of such an agitator is more than 50 years or is unwilling to serve himself due to physical and mental disability, then his dependents will be given 10 percent horizontal reservation in state services.
Agitators who go to jail for less than seven days will be given 10 percent horizontal reservation in government services. The dependents include the wife, husband, dependent son and unmarried daughter, widow and abandoned divorced daughter of the identified agitators.
What happened when
The government order to give reservation was issued in the year 2004.
The Nainital High Court banned 10 percent horizontal reservation to Uttarakhand state agitators in the year 2011.
In the year 2015, the High Court, while hearing this case, declared this reservation unconstitutional.
In the year 2015, the then Congress government passed the reservation bill from the assembly and sent it to the Raj Bhavan.
In September 2022, after seven years, the Raj Bhavan returned the bill.
In March 2023, the cabinet took the decision to bring the bill again.
In September 2023, the cabinet passed the proposal to bring the bill.
On September 7, 2023, the Legislative Assembly handed over the bill to the Select Committee.
On November 11, the Select Committee submitted the report to the Speaker of the Legislative Assembly.
In February 2024, the House unanimously passed the bill and sent it to the Raj Bhavan.
After the approval of the Raj Bhavan, the way is cleared for the Act to be made on August 18.
