
Demolition of three houses under the removal of encroachment campaign in Dehradun, Uttarakhand has proved costly for the Municipal Corporation. The court has issued an order to rebuild all three houses. Not only this, the corporation will also have to pay compensation of Rs 1,000 per day to the house owners from October 2020 till now. The court of Second Additional Civil Judge Indu Sharma has given this decision against the action of the Municipal Corporation. The court acknowledged that at the time this action was taken, the properties were under dispute. In such a situation, this action is against the rules. The court has given one month’s time to get the house constructed. The Municipal Corporation had taken action against encroachment in Niranjanpur during the Corona period in October 2020. During this period, the houses of Sarita wife Harinath, Guddi wife Surendra Singh and Shanti Devi wife Babulal were demolished and they were evicted from here. After this action of the Municipal Corporation, the victims approached the court.
Told that in the year 1995, backward and scheduled caste homeless people were given plots in Niranjanpur. Out of these, these three victims were also given plots. After this, he constructed houses on these plots with his own income. From that time onwards all the people became occupied here and their names were also entered in the government documents. After this, in the year 2003, notices were issued by the Municipal Corporation claiming this land as its own. It was said that if they did not vacate the land, they would be demolished with the help of police and administration. When he approached the police, they did not help him and asked him to approach the court.
While presenting his views in the court, he obtained a stay order on this order of the Municipal Corporation. Meanwhile, the Municipal Corporation took action and demolished the houses of three victims. In the court, the victims had demanded construction of their houses and compensation.
Victims’ advocate Jitendra Kumar said that on April 12, Second Additional Civil Judge Indu Sharma has given the verdict against the Municipal Corporation. The court found that there was a litigation going on in the court regarding these properties.
Despite this, the Municipal Corporation took this action, which is against the rules. In such a situation, the victims are eligible to get compensation. On the other hand, the Municipal Corporation has started preparations to go to the High Court against this order of the District Court.
